NAFTA 2.0, you know the ‘USCMA’, is unlikely to be ratified (political-wire.com)

Playbook: “This is exceedingly unlikely to be ratified this Congress. That’s what every senior Republican and Democratic aide on Capitol Hill says. It’s going to require a massive whip effort, and the House is out until after the election. If Republicans lose the House, there will be an effort to jam this through in the lame-duck. That will be really tough.”

Oliver is right. Public pressure works.

Of course it does. And too many times people forget it and give up thinking they won’t have any bearing on a politician if they contact them by email, or calls.

Politicians do not like to hear it. Remember how often Republicans were getting hammered at their own town hall meetings and tried to control who was invited to attend or gave up holding them at all?

They can ignore the pressure if they want…at their own risk of their political careers.

I don’t think this has hit the news in the USA but football (soccer) star Ronaldo is accused of raping a woman in Las Vegas and then covering it up. The woman signed an agreement and was paid off

So, LOTS of trigger warnings but I found the end of the article (in part 2) interesting from a legal perspective. The woman’s new lawyer is trying to have the contract made void for two reasons. First, the woman was psychologically not competent to sign. Second, the contract is void as it covers up a criminal act.

I don’t think we’ve had an explicit ruling that this kind of contract is void for covering up a rape. (Please correct me if I am wrong.)

Here’s the story.

Part 1
m.spiegel.de

Part 2

m.spiegel.de

Again, trigger warnings abound. I admit to skim skipping some paragraphs after the first assault.

I don’t think we’ve had an explicit ruling that this kind of contract is void for covering up a rape. (Please correct me if I am wrong.)

As a general rule, settlement and non-disclosure agreements include a clause saying that the parties won’t talk to anyone about the underlying events, but there’s usually an exception for legal proceedings. Even without that provision being included, it would probably be considered part of the law of the contract (what is sometimes called an implied term). That said, if it came to a criminal investigation, there’s plenty of instances where potential witnesses refuse to cooperate with the police - that happens a lot in domestic violence cases, I believe.

Contracts for illegal things are void as a matter of law - you can’t hire someone to kill your spouse and then sue them for breach of contract when your spouse comes home on Friday night.

lets all remember there are two very different things going on here for the d’s and r’s:

Another deluded rant from the Nazis. She is a research psychologist but her expertise is as a data analyst (i.e., psychological statistics). Her role on the study in 2008 was analyzing the data (onlinelibrary.wiley.com). The media is trying to turn into her some Jedi Zen master of psychology, but her academic career is applied statistics. I have worked with similar scientists over the last several years.

What I took away from last Thursday is that Brett Kavanaugh is a man comfortable with lying. The bit that truly emphasized that was when he was asked about his claims of being a virgin through high school and he insisted he boasted about faux sexual conquests in high school to avoid “embarrassment.” So either he was lying then or he’s lying now. Either way, he doesn’t seem to feel that there was anything wrong with it.

The stained blue dress only ever became evidence because Linda Tripp told Monica not to clean it and then clued investigators about its existence. She also turned over taped recordings of phone conversations. Without either action, it would have been a “he said/she said” situation.

20 years later, the GOP wants to ensure that there are no Linda Tripps out there who are gonna come forward with the goods on Brett Kavanaugh, the man who helped lead the crusade that lead to that blue dress.

Fate is not without a sense of irony.

Cliff notes: Ex-girlfriend came out just before the primaries to accuse him of physical abuse, the biggest claim being that he physically dragged her feet-first from a bed while screaming obscenities at her and that she had video evidence of such. The WI DNC launched an investigation, the attorney investigating questioned the ex but she has put forward three different excuses for why she can’t produce the video, so the draft report that the press got ahold of says the attorney has concluded the ex’s allegations are “unsubstantiated.”

The GOP jumped on the Ellison allegations because they wanted to accuse the DNC of “hypocrisy,” i.e. that if we must take every woman at what she says (something no Democrat is actually saying), then he must resign from the race because of the allegations made against him.

The lynchpin was that the DNC wasn’t taking the matter “seriously,” that they weren’t investigating it but instead “covering it up.” The news about this investigation reaching a close isn’t going to shut them up, it’s going to lead them to calling it a “whitewash” and demanding another investigation.

In one message, Yarasavage said Kavanaugh asked her to go on the record in his defense. Two other messages show communication between Kavanaugh’s team and former classmates in advance of the story.

The texts also demonstrate that Kavanaugh and Ramirez were more socially connected than previously understood and that Ramirez was uncomfortable around Kavanaugh when they saw each other at a wedding 10 years after they graduated. Berchem’s efforts also show that some potential witnesses have been unable to get important information to the FBI.”

Well, looks like Flake’s trip wire has been…well, tripped. Kavanaugh lied to Congress and the FBI has the evidence to prove such. Will Flake now rescind his support for Kavanaugh’s nomination? Will Collins, Murkowski, and Manchin go forward supporting a man who perjured himself on live TV?

Angry whitehousestaffer has been hinting that his sources suggest he is going to be forced to withdraw.

You can certainly see why the FBI was directed not to interview Kavanaugh. Lying to them is not like lying to the Senate GOP, the FBI will charge your ass for doing so.

That is the question. Flake obviously badly wants to vote for Kavanaugh if he can.

Impeachment is a high bar. Instead they could just use a combination of committee hearings and the censure rules to expose everything then haul Kavanaugh back in and formally reprimand him and the Republicans who willfully hid evidence of his perjury. That’s what I’d probably do, just expose the depth of the rot for all to see.

Collins, Murkowski and Manchin have tied themselves to Flake for this confirmation battle. However he votes, they will too.

He’ll either be forced to withdraw or the GOP will find themselves taking a very uncomfortable vote before week’s end. Their hope that they could confine this to just discrediting Dr. Ford is dissolving before their eyes, as is their efforts to portray Brett Kavanaugh as this awesome guy who everybody loves.

I’m saying if the Dems take control of Congress. Censure only requires a 50% vote. It’s essentially toothless grandstanding, but if backed by enough evidence in public hearings could provide a powerful spectacle embarrassing the GOP.

By this point, there’s four possible outcomes:

- The White House is forced to withdraw the nomination, which would spare the GOP some of their base’s wrath as Donny would be sure to blame the act on “dirty tricks” by the DNC.

- Kavanaugh is forced to withdraw from the nomination, which would lead to all sorts of anger directed at the GOP for failing to defend him from said “dirty tricks” by the DNC

- The GOP take it to a full Senate vote and he goes the way of Bork, leading to howls of outrage from their base that will drown out a 747 at full throttle

- The GOP take it to a vote and he’s confirmed, which will cost them the Senate but ensure they put a far-right candidate on the bench and lock in a 5-4 majority for the foreseeable future

This is only the preliminary stuff coming out now. By the time that FBI report is done, they might have a massive pile of incriminating shit on their hands.

Remember last Monday, when everyone thought confirmation was a lock?

Possibly in a month, but definitely in two years. I’d remind folks that a year ago, it was accepted as inevitable that the GOP would keep and likely expand their Senate majority simply because of the number of seats the DNC had to defend.

Two weeks ago, it was a foregone conclusion that he’d be confirmed before week’s end. A week ago, we expected that the hearings would be followed by a quick vote to confirm. And two days ago, it was accepted that the GOP would have him confirmed by tomorrow afternoon.

If the Democrats take control of the Senate, McConnell loses much of his power over the Republican caucus. The minority leader has a harder time controlling his/her caucus because he/she can’t decide what bills are brought up. McConnell has wielded his power amazingly well (not for good purposes, obviously, but in a ruthless Machiavellian way of consolidating more and more power for its own sake), but if he loses it, there’s no reason to believe more “moderate” Republicans will continue with his gamesmanship (especially those up in 2020 in bluer/purpler states). Hell, if they lose the majority, he’ll likely be challenged as the caucus leader, assuming his geriatric ass sticks around.

There are several R incumbents in California in trouble, but the indicted one isn’t.

Until the election, we don’t know who is in real trouble and who isn’t. Three weeks before the NY primary, a poll showed Joe Crowley leading AOC by 36%. The unexpected happens — especially in low turnout elections like primaries and off-year general elections.

So I see Kristy Swanson has come out as full-on MAGA troll. thedailybeast.com

Kristy Swanson has more than a few … skeletons in her closet, shall we say?

Kristy should be very, very careful.

There are a LOT of skeletons in her closet.

There are also tapes.

She used to call my friend up while they were working on a movie together, and leave incoherent, howling messages on his voicemail box until it filled up. Day after day.

Even Charlie Sheen (who she was on the movie with) used to describe her as “Batshit crazy.”
